Cummins, Pettit and O'Neil. Minute No. 7 was read and approved. Motion by Mr. Pettit, seconded by Mr. mains, that the proposal of Joseph E. Short, Donors, Pa., for the re -arrangement of the Sheriff's Office to provide Offioe space for the Coroner be accepted, as follows: "W proposed bid for the furnishing of Materials & Labor for erecting partitions; for offices for the Coroner, etc., according, to plan and detail, and including all materials as mentioned on detail, Hardware and Painting, is the sum of THREE XMIDRED AND FIFTY-NINE DOLLARS and KIGIM CENTS ($359.80);" said work to be started within ten days from notice of acceptance of proposal and completed in a workmanlike manner, subject to final approval of the Board of Commissioners. Motion carried. Motion by Mr. Pettit, seconded by Mr. Cummins, that William Butler be employed as a Clerk in the Real Estate Office for the year 1944, effective January 16, 1944, and covering the period from that date to the first Monday in January, 1945, with the proviso that he may be dismissed upon thirty days' notice. Motion carried. There being no further business to toms before the Board, the meeting was adjourned. Cummins, Pettit and O'Neil. Minute No. 8 was read and approved. Motion by Mr, Pettit, seconded by Mr. Cummins, that H. W. Minnemeyer, of Washington, Pa,, be appointed to fill the vacancy created by the resignation of J, Brady Marble as a member of the Washington County Council of Defense, Motion carried. Motion by Mr, Pettit, seconded by Mr. Cummins, that the following resolution be adopted: WHEREAS, at tax sales held by the Treasurer of Washington County, Pennsylvania, in April, 1940, certain real estate was sold by the County Treasurer to the County of Washington, which real estate was situate in the Borough of McDonald, County of Alleghezw; and YGIEREAS, said tax sales were held on the basis of tax liens improperly filed by the -tax collector of the Borough of McDonald in the Office of the County Treasurer, Washington County, Pennsylvania, which were for delinquent taxes due to either the Borough of McDonald or to the McDonald Borough School District (see Act of June 28, 1923, Sec. 5, as amended); and MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA R❑SS R. WHEREAS, it is a matter of law that said sales are invalid for the reason the real estate which was sold was based on the entry of tax liens against real estate situate in the County of Allegheny rather than in the County of Washington; and WHEREAS, as the result of said sales the real estate therein concerned was removed from the tax duplicate of the tax collector for the Borough of McDonald and no taxes have been paid by the owner of said real estate to the Borough of McDonald or the McDonald Borough School District since the date said sales were held by the County -Treasurer and the title to said real estate has been in the County of Washington; and I WHEREM, the County of Allegheny has been collecting the County Tax on said i Real Estate (see Sec. 614, Act 254, of May 210 1943); NOW, THEt1:'EFORE? BE IT RESOLVM. that the tax sales held by the Treasurer of Washington -County in April of 1940 pertaining to the real estate hereinafter mentioned and now owned by the County of Washington, are hereby cancelled and declared invalid for the reason that said real estate is situate in the County of Allegheny and no jurisdiction existed under the provisions of law for the Treasurer of Washington County to make sale of said real estate based on Borough and School tax liens entered in the Office of the Treasurer, Washington County, and the County Treasurer is hereby authorised and directed to mark the records in connection with each of said sales cancelled and invalid, and the Clerk of the County Commissioners directed to notify the tax collector of the Borough of McDonald of the cancellation of said sales and to have the real estate hereinafter mentioned entered on the tax duplicate for the purpose of the Borough and School taxation in the Borough of McDonald. Toll Gate property on National Road West of West Alexander;" such sale being in error in view of the fact that the property is not taxable under and by virtue of the decision of the Supreme Court in the Case of Commonwealth of Pennsylvania vs. Dauphin , County, 335 Pa. 177, therein it is provided that properties o,med by the Commonwealth of Pennsylvania or any agency of the Commonwealth of Pennsylvania cannot be taxed under existing lawn Motion carried, and the proper clerk in the Assessment Office directed to correct the assessment records, as well as the Lien Dockets in both the Prothonotaryts and Treasurer's Office,wherein taxes covering above property are liened in the name of the Commonwealth of Pennsylvania for the years subsequent to those for thich the property was sold to Washington County.
