O'NEIL, COMMISSIONERS Motion duly made and seconded that the following Resolution be adopted: j BE IT RESOLVED by the County Commissioners of Washington County that the plans submitted by the Department of highways for the changing of State Highway Route 62135, between Stations 264.7150 and 276/00, in East Finley Township, have I been examined and the County Commissioners agree that the County will not assume ! liability for any property damages resulting from the construction of the highway as contemplated by these plans, or any damages arising out of any changes or alteration of drainage resulting from the construction or maintenance of the j highways, or any damages resulting to any property or holdings of any Public I Utility Company; or any and all damage resulting to any coal or other minerals in and underlying the property affected by this improvement, i Motion carried. I There being no further business to come before the Board at this time, the meeting ! was adjourned. Motion by Mr. Pettit, seconded by Mr. Cummins, that Harry Richards be employed as N;Assistant Building Engineer, to replace Colin Swingle, now in military service, effective March 1, 1944, and covering the period from that date until the first Monday in January, 1945, with the ! v � proviso that he may be dismissed upon thirty days* notice. L. 166, effective for the coming Primary to be j} held April 25, 1944; and that the action taken in Minute No. 20, under date of March 3, 1944, be here- by rescinded as to that part thereof only fixing the rate of pay for constables, it appearing that the same is in conflict with the Act of Assembly set forth above. Motion carried. I I Motion duly made and seconded that the County Treasurer be authorized to cancel f Treasurer's Tax Sale of March 24, 1942, to Huler E. McKinney, 52 Sumner Ave., Washington, Pa., covering property assessed in the name of Theodore Dyers in the Sixth Ward of Washington, de- l� scribed as House & Lot 73,.—� E. Hallam Avenue, for the non-payment of 1935 County Tax, such sale I being in error in view of the fact that the said property was also assessed for 1935 County Tax in the name of H. H. Williams, the rightful owner, and receipts have been produced showing payment t of the tax in question. Motion carried. Motion duly made and seconded that the County Treasurer be authorized to cancel Treasurer's Tax Sale of January 24, 1940 to Washington County, covering property assessed in the name of John Rossi, in Smith Township, and described as Lot No. 7, Donnan Plan, for the follow- ing reasons: Said lot, assessed in the name of John Rossi, was sold at 'Treasurer's Tax Sale in 1921 to John Reagan, who in turn sold it to Leon Kasmacki, in whose name it is now assessed. However, at the time of the sale in 1921 John Rossi was not the owner of said lot and, in accordance with an opinion handed down by Judge Burnside in a similar case, the 1921 sale would be void and Leon Kasmacki is not the rightful owner. Said Lot No. 7, together with No. 8 and No. 9 in the Donnan Plan, were purchased by Leon and Juliette Donez, but records do not show Lot No. 7 as being assessed to them. By conveyance through the Donez chain of title, Battista Maroni is now the owner of Lot No. 7. motion carried. Motion duly made and seconded that the County Treasurer be authorized to cancel tax sale of April 25, 1940 to Washington County, covering property assessed in the name of Margaret Vernon in East Pike Run Township, described as Lot No. 220 in West Side Land Company Plan, such sale being in error in view of the fact that the assessment upon which the sale was made was a duplicate of the assessment of Marko Patrlyja for the years in question, Margaret Vernon never having owned said Lot No. 220, Motion carried. Motion duly made and seconded that the County Treasurer be authorized to abate penalty and interest on delinquent 1938 County Tax assessed in the Third "hard of the City of Washington in the name of Washington Trust Company against property now owned by Nellie V. Bryant in view of the fact that the said tax was not included in a statement of taxes issued by the County Treasurer's Office to the present owner, Nellie V. Bryant, at the time of purchase.
