O'NEIL, COMMISSIONERS 7zsze-- -- — --.�_------- ----------- - -- ---- I NO. 121 Office of the County Commissioners, Washington, Fa.., October 2, 1940, i County Commissioners in regular session, specially called, those present being Messrs. Berryman Cummins and O'Neil. Motion by Mr, Cummins, seconded by Mr. Berryman, that the contract for the necessary repairs to the Claysville-Burnsville Road be awarded to the Northern Bituminous Corp., Washington, Pa,, at 1 their bid price of 6435.00 for 1100 tons Wedge Course & Seal material, mixed in place, using limestone aggregate. Chairman Berryman then called for remarks and Mr. O'Neil offered the following: "I objectin and protest the awarding of this contract to the Northern Bituminous Corporation for the reason that at the time of the opening of the bids, Mr. Meister, representing the Northern Bituminous Corporation at that time stated that his bid was for slag aggregate and that in preparing his bid blanks, he had inadvertently placed the slag bid on the limestone blank, The question was raised at that time as to whether or not the bid would be accepted and it was the decision then that the bid would be received as read and a decision rendered and disposition made later on. To my know- ledge, no decision has been made as to whether or not Mr. Meister's bid was to be for limestone or slag and for this reason, I feel that it is not a legitimate bid on this particular contract, Furthermore, the cost of the limestone aggregate as compared to the slag aggregate will cost Wash- ington County 500 more and since it has been a practice to use slag aggregate over a period of years after successful tests have been given to limestone and slag aggregate, I can see no reason to spend the additional money on this particular contract when slag aggregate, at less money, gives the same results. I particularly want this called to the attention of the Controller if he sees fit to approve this contract and that he be notified of my decision in this matter." The following remarks were then offered by Mr, Berryman; "As far as I can see, the bid has been presented like former bids have always been presented and seemed to be in true form." Mr. Cummins then offered the following remarks. -"Mr. Meister made his bid as limestone aggregate on the form calling for limestone. He personally appeared before me and stated that his bid was for limestone and that if granted the contract, that material would be used. Basing my opinion on in- formation received from various engineers, I believe that limestone is a better aggregate than slag for this particular type of work and for that reason, I am in favor of its use." Question called for: Voting "Yes", Messrs. Berryman and Cummins, voting "No", Mr. O'Neil and wishing his vote so recorded. Minute No.,120 was read and approved by the Board.
