NO. 248 Office of the County Commissioners,
Washington, Pa., December 12, 1941•
Board of County Commissioners in regular session, those present being Messrs. Berryman,
i Cummins and OtNeil.
Notion by Mr. Cummins, seconded by Mr. Berryman, that the following Resolution be adopted,
to -wit:
WHEREAS, by its agreement dated August 4, 1941, the Northern Bituminous Corporation, Washi.ngto,
Pennsylvania, did contract and agree to construct and improve the Claysville-Burnsville Road, in
East Finley Township, Washington County, Pennsylvania, within the period August 1, 1941, to Septem-
ber 15, 1941, and
WHEREAS, the said period has since expired and the said contractor has failed to complete the
said road with the said period, now, therefore,
BE IT RESOLVE By the County Commissioners of Washington County, Pennsylvania, that by reason
of the failure of the said Northern Bituminous Corporation to complete the said road in accordance
with the terms of its said contract and agreement, the said Northern Bituminous Corporation=is, and
is hereby declared to be, in default under the said contract and agreement and the Hertford Acciden
and Indemnity Company, as surety for the performance of the said contract and agreement, be, and
they are hereby' called upon to complete the said road in accordance with the said contract and the
bond executed and filed in connection therewith, Motion carried.
There being no further business before the Board, the meeting was adjourned.

Board of County Commissioners in regular session, those present being Messrs. Berryman,
Cummins and O*Neil.
Motion by Mr. Cummins, seconded by Mr. Berryman, that Paul Sikora, 136 Elizabeth Street,
Washington, Pa., be named to succeed Arthur Grimes, deceased, as Assistant Engineer at the boiler
rooms for the Court House and Jail for the remainder of the year 1941, Motion carried.
Motion duly made and seconded that the following Resolution be adopted by the Board, to -wits
BE IT RESOLVED that hereafter no reduction in the assessment or acreage on account of arty eoall

mined shall be made or allowed unless the ovmer or owners of the said coal shall clause to be filed
in the Office of the Board of Revision on or before February 15th of the year in which such reduo-
i tion is sought, a statement under oath made by a competent person having knowledge thereof, showing

the total acteage and assessment at the beginning of the calendar year in question and a detailed
statement of the coal so mined and removed during that calendar year. Motion carried, with all
coal companies affected by the foregoing resolution to be notified of this action of the Board*
Minutes No. 247 and 248 were read and approved by the Board.
There being no further business before the meeting, it was adjourned.

Board of County Commissioners in regular session, those present being Messrs. Berryman, Cummins
and O'Neil.
Motion duly made and seconded that the following Resolution be adopted by the Board, to -wits
WHEREAS, it has been proposed that the Legislature in =nneotion with its legal duty to re-
apportion the Congressional Districts of Pennsylvania, refrain from a general re -districting of
the State and only re -district in isolated instances; and
WHEREAS, it has been brought to the attention of this Board that the Legislature intends to
dividd the 25th District by eliminating therefrom Greene County and attaching to this district a
portion of Allegheny County; and
WHEREAS# it appears to this Board that this plan is manifestly unfair and unjust and would
be prejudicial to our County, State and Nation;
NOW, THEREFORE, BE IT RESOLVED that this Board go on record as protesting the proposed divi-
sion of the 25th District and particularly the elimination therefrom of Greene County; and
BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to each of the Assembly-
men and the State Senator of this County, the Governor of Pennsylvania, the president pro tem of
the S@uate and the Speaker of the House, with the suggestion that this District be left as it ist
subject to the right of the Legislature to add a portion of Allegheny County thereto if neces-
sary to make up the required number in population for the District. Motion carried.
Motion duly made and seconded that approval be given to the agreement executed between
Washington County and Charles 0. Allender, Claysville, Pa., covering the laying of a S/4" gas
line across the Claysville-Burnsville Road in East Finley Township for the purpose of carrying
gas under said road for a distce of 33 feet, more or less. Motion carried.
Motion duly made and seconded that the County Treasurer be authorized to cancel Treasurers
Tax Sale No. 14419 held January 24, 1940, for 1927 delinquent county tax, in the name of Hart &
McGlumphy, 6thWard, City of Washington, covering a lot assessed on West Katherine Avenue in said
