Board of County Commissioners in regular session, those present being Messrs. Berryman, Cummins
and. Of Neil.
Motion duly made and seconded that the County Controller be authorized to advertise for bids fb�,

the furnishing and delivery of approximately forty-two thousand (42,000) board feet of treated Yellov
Pine Lumber, S-4.5, to be used on various county bridges; this material to comply in all respects
i
with the specifications of the Pennsylvania Department of Highways for treated lumber for bridge
+ decking; proposals and specifications may be obtained at the Office of the Engineering Department,
i Court House, Washington, Pa; certified check in the amount of 200.00 must accompany each bid and
the right is reserved to reject any or all bids, or to make such an award as will be to the best
I interests of Washington County; bids to be received by the County Controller until lltOO A*M*,
E.S.T., February 6, 1942, and opened immediately thereafter in the Office of the County CammissioaerE.)
Motion carried.
County Controller Stuard was then called into the meeting to discuss the matter of awarding the
contract for liability insurance for damage on account of personal injuries to any person or persons
(excepting employees) caused by or resulting from the existence of, repairing and/or maintaining of
the various buildings and properties of the county or the county highways and bridges.
Motion by Mr. Cummins, seconded by Mr. O'Neil, that the contract for the aforementioned liability
insurance be awarded to Henry O. Hood & Sons, Washington, Pa., at their bid price of $1788.60, as set
forth in their bid of January 23, 1942, for a three-year period, effective at noon, Januaay 28, 1942«
Motion unanimously carried with County Controller Stuart present at the time of the awarding of this

j contract, and hereby authorized to return the checks of the unsuccessful bidders.

There being no further business before the Board, the meeting was adjourned.

In order to comply with the request of the Pennsylvania Department of Highways and to avoid
possible damages to the Pennsylvania Railroad Company at their grossing on Route 62157 in Fal.lowfie14
Township, motion was duly made and seconded that the action taken by this Board under date of Septem-
ber 27, 1941, wherein an affirmative resolution was adopted in connection with the assumption of
damages in the changing of State Highway Route No. 62157 in Fhlloarfield Township, be rescinded and

approval be given to the adoption of the following resolution executed under date of January 29�
1942, in connection with the said damages:
BE IT RESOLVED by the County Commissioners of Washington County, that the plans submitted
by the Departmentsof Highweys for the c of State Highway Route 62157, in Fallowfield Thwn-
ship, between Stations 0s36*57 and 9#30, have been examined and the County Commissioners agree
that the county will assume liability for any and all property damages resulting from the con-
struction of the highway as contemplated by these plans, and also all damages arising out of any
changes or alteration of drainage resulting from the construction or maintenance of the highway,
excepting and reserving from the intent of this Resolution aW property or holdings of any
Public Utility. Company. Lotion carried,
Motion duly made and seconded that approval be given to the adoption of the following reso-
lution executed under date of JanUayy 291, 1942t
BE IT RESOLVED by the County Commissioners of Washington County that the plans submitted by
the Department of Highways for the changing of State Highway Route 24% Section 17, in Union
Township, between Stations 664#00*00 and 685#75.00, have been examined and the County Commissioners
agree that the county will not assume liability for any property damages resulting from the con-
struction of the highway as oontemplated by these plans,. or any damages arising out of any' changes
or alteration of drainage resulting from the construction or maintenance of the highways. Motion
carried,
WHEREAS, an agreement was entered into with James S• Pates in connection with lanai damage due
him fow the relocation and reconstruction of the county road in Chartiers Township through his land
M.
VHEREAS, the agreement reached was to pay him the sum of 50.00 and, the amount of all delin-
quent taxes against the said property to the date of said Improvement, and
WHEREAS, by an agreement filed at No. 303 November Teruo, 1939, A.D., the amount then arrived
at was $591.94, and
WHEREAS, by mutual mistake of fact there was omitted from said agreement the 1932 County tax
liened against the Export Coal Company at No* 1432 August Term, 1938, M.L.D., which should have
been included in said agreement, being in the amount of $131.79, and,
WHEREAS, the said James S. Pates, has, through an oversight, paid the suss of $52072 on ao-
count of said lien, motion is duly made and seconded that the agreement aforesaid is hereby
modified so as to include the 1932 county tax aforesaid and the said lien is hereby directed to
be satisfied of record and the sutra of 52.72 paid on account thereof, through mistake, is hereby
directed to be refunded to the said James S. Fates. Motion carried,
Minute No. 260 was read and approved by the Board*
there being no further business before the Board, the meeting was adjourned*
