Board of County Commissioners in regular session, those present Boeing Messrs, Berryman, Cummins •6 and O'Neil. Motion duly made and seconded that special warranty deeds be executed and delivered to James D. and E. Blanche Wilson, Joseph C. Mazzie and the Ross Independent Oil Company for the lot of ground in the 7th Ward of the City of Washington, situate at 815 Jefferson Avenue, 817 Jefferson Avenue and 15 Oakland Avenue, sold to Washington County by the County Treasurer for non-payment of taxes on January 24, 1940, and which was redeemed by the parties aforesaid under the Act of July 28, 1941, i I P.Le 535, and that John D, Berryman be authorized and empowered to execute and acknowledge the same as and for the Board of County Commissioners; also that a special warranty deed be executed and de- i livered to Joseph E, and Mary 6. Short for Lots No. 266 and -No. 267, Eldora Flan il, Carroll Township, I Washington County, Pennsylvania+, sold to Washington County by the County Treasurer for non-payment f of taxes on January 26, 1940, and which was purchased by the aforesaid parties at Public Sale March i 20, 1942, under the provisions of the Act of Assembly governing such matters, and that John D. Berry- man be authorized and empowered to execute and acknowledge the same as and for the Board of County Commissioners. Motion carried. Motion duly made and seconded that the resolution adopted by this Board on January 30, 1940, with respect to property damages on State Highway Route -#62157 in Fallowfield Township be and the same is hereby rescinded. Motion carried. Motion duly made and seconded that the following resolution be adopted in connection with ! property damages on State Highway Route No. 62157 in Fallowfield Township, to -wit: BE IT RESOLVED, By the County Commissioners of Washington County, that the plans submitted by , the Department of Highways for the changing of State Highway Route #62157 in Fallowfield Township, between Stations 0s36,57 and 9♦300 have been examined and the County will assume liability for any and all property damages resulting from the construction of the highway as contemplated by these plans, and also all damages arising out of any changes or alteration of drainage resulting from the 3 construction or maintenance of the highway, EXCEPTING AND RESERVING from t he intent of this Resolu- tion any property or holdings of any �Rublie Utility Company; ALSO EXCEPTING AND RMERVING from the j intent of this Resolution any and all damages resulting to any coal or other minerals in and under- I lying the property affected by this improvement. COMMISSIONERS j F� E Motion duly made and seconded that the agreement between Washington County and T. J. Hughes, Donegal Township, this county, be executed covering the quarrying of all stone from January 2, 1942 to January a, 1943, for the payment of the sum of $75.00 by Washington County, the lessee of a certain tract of land located on the Claysville-Bethany Road in Donegal Township. Motion carried. Motion duly made and seconded that the final payment in the amount of $387,50 be approved in favor of the Knestrick Electric Company, Washington, Pa., in connection with their contract with ;Washington and Westmoreland Counties for the re -wiring of the Donora-Webster Bridge, the afore- said company having submitted a ten-year unconditional guarantee covering the material in the hangers and brackets installed on the said bridge to substitute for those specified in the original contract. Motion carried, Westmoreland County Commissioners having taken similar action (in accepting the guarantee of the Knestrick Electric Company in'connection with the installation lof the substitute brackets and hangers. Motion duly made and seconded that the County Treasurer be authorized to accept the balance i jdue, without penalty and interest, on the 1933 county tax liened in the Prothonotaryts Office, inasmuch as the tax was inadvertently omitted when a statement of all liened and delinquent taxes was rendered to the owner of the property in question, viz., Linda Larimer, 3rd'6`6'ard, Monongahela City. Motion carried. Motion duly made and seconded that the County Treasurer be authorized to accept the balance due, without penalty and interest, on the 1932 and 1933 county tax against the DeCas Construction Company, Speers Borough, inasmuch as the payments covering the said balance were inadvertently overlooked when making settlement in connection with liened and delinquent taxes under the provi- Isions of Act 233, Motion carried. Motion duly made and seconded that the County Treasurer be authorized to void the Treasurer's Tax Sale held January, 1940, in the name of Joe Kennedy, Cecil Township, against property right- fully situated in the Borough of " onald and owned by Saunders Bennett, the said sale being in error inasmuch as the property sold in the name of Joe Kennedy was a duplication of that right- fully owned by Saunders Bennett. Motion carried. Motion duly made and seconded that the County Treasurer be authorized to exonerate the 1935 county tax liened in the name of Isabell Marshall, in the Borough of Bentleyville, inasmuch as the said 1935 county tax was inadvertently omitted in the certification of all liened and delinquent taxes to the Sheriff when the said property was sold at Sheriff's Sale on May 1, 1936, sufficient money having been paid at said sale to cover the taxes in question had they been properly certified,. Motion carried. Motion duly made and seconded that the County Treasurer be authorized to accept the balance, *ithout penalty and interest, on liened and delinquent county tax for the years 1935 thvough 1940, in the name of Logan Stoner, on property situate in the Borough of Charleroi, such action being taken in cooperation with the School District and Borough Council of Charleroi Borough. Pepper, East Pike Run Township, i without penalty and interest, such action being taken in cooperation with the School District and Board of Supervisors of East Pike Run Township. Motion carried. Motion duly made and seconded that the County Treasurer be authorized to accept liened and delinquent county tax for the year 1932 in the name of the Thomas W. Pepper Estate in West Pike Run Township, without penalty and interest, such action being taken in cooperation with the School District and Board of Supervisors of the said township. Motion carried, � Motion duly made and seconded that the County Treasurer be authorized to accept liened and delinquent county tax for the year 1933 against the property of Mike Demo in the Borough of Bentley- villa, without penalty and interest, such action being taken in cooperation with the School District- and Borough Council of Bentleyville. Motion carried. i Motion duly made and seconded that the County Treasurer be authorized to accept leinad and delinquent county tax for the years 1928-1932-1933 against the property of Charles P. Jones, Fallowfield Township, without penalty and interest, such action being taken in cooperation with the School District and Road Supervisors of Fallowfield Township. Motion carried. ; Motion duly made and seconded that the County Treasurer be authorized to accept liened and de- linquent county tax for the years 1935 and 1936 against the property of John Horton in Centerville Borough, without penalty and interest, such action being taken in cooperation with the School District and Borough Council of Centerville. Motion carried* Motion duly made and seconded that the County Treasurer be authorized to accept liened and 4nd delinquent county taxes for the years set forth, without penalty/interest, against the following properties situate in Cecil Township, such action being taken in cooperation with the School District " and Road Supervisors of the said township: (1) Panfilio Conoscuto Property for the years 1931-32-33-34-35-36 (2) James Cassidy Property for the years 1932 through 1940 (3) Mary Daccorso Property for the years 1932 and 1933 (4) Prank Daccorso Property for the years 1932-33-34-35 (6) John Gullo Property for the years 1935 and 1936 (7) J. Kerr McCarty for the year 1936 (8) Henry DeSantis Property for the years 1932 and 1933 (9) Elizabeth Hossler Property for the years 1935 and 1936 (10) T. D. Gladden Property for the years 1934-35-36 Motion carried. Minutes No. 278-279-280-281 were read and approved by the Board. There being no further business before the Board, the meeting was adjourned.
