O'NEIL, COMMISSIONERS -- such exonerations being requested due to sales, settlements, duplications, etc. � Motion carried*, The Board confirmed the execution of an Agreement between Washington County and the Sinclair I Refining Company, Harrisburg, Pa., under date of December 11, 1942, covering the laying of a six- inch pipe line for the purpose of conveying oil, gasoline, etc., under the county road in Peters Township from Donaldson's Corners to McMurray, for a distance of 50 feet, more or less, The Board also confirmed the reading of Minutes Not 321 end 322 under date of December 7, 1942. Board of County Commissioners in regular session, specially called, those present being Messrs. Berryman, Cummins and O'Neil. WHEREAS, the Contract with the Northern Bituminous Corporation for the constructon of the bituminous wedge course on the Claysville-Burnsville Road in East Finley Township has heretofore been declared in default, and WHEREAS, the H&TVif rld Accident and indemnity Company, the surety on the Performance Bond filed in connection with said contract, has caused the said road to be completed in accordance with the terms of the said contract and the final estimate therefor shows the amount now payable thereunder to be $1,719.63, and AREAS, the said Hartford Accident and Indemnity Company has agreed to pay or cause to be paid, all the claims for labor and material that are or might be claims against the county arising out of the completion of the said contract, and WHEREAS, there is due and payable to the county for rental of a grader from the Northern Bituminous Corporation from September 20, 1941 to December 19, 1941, the sum of $500.00, used in the performance of the said contract, and the scan of $81,00 for labor performed by Orval McAdoo on said road and assigned to Washington County November 2, 1942, NOW, THEREFIDRE, upon motion duly made and seconded, it is resolved that payment of the amount now payable, to -wit, 1,719.63, less the rental aforesaid of 500.00, and the labor claim of the said Orval McAdoo of $81.00, be made to the said Dartford Accident and Indemnity Company, and upon the payment of the claims heretofore mentioned for labor and material, it is further resolved that the said Hartford Accident and Indemnity Co. be discharged from all further liability under the said contract and their Performance Bond filed in connection therewith, but subject, nevertheless, to their obligation and liability to d eftind the suit now pending against the County of Washington by th,a Peoples' National Bank of Washington, Pennsylvania, at No. 196 February Term, 1943, and to save the county from any and all liability on account thereof, in accordance with the agreement of the said Hartford Accident and Indemnity Company made in consideration of this and prior paymenta under the contract aforesaid. Berryman, Cummins and O'Neil. Motion duly made and seconded that the following persons be named as Members of the Wash- ington County Transportation Committee to supervise and manage an Organized Transportation Plan for persons employed by Washington County and connected with the official business of the county government as provided in the Regulations of the Office of Price Administration: Anthony Mote, Chartiers Township; Paul Pettit, Washington, Pa; Joseph T. Langenbacher, Wask- ington, Pa. Motion carried. Minutes No. 319-320 were read and approved by the Board. There being no further business before the Board, the meeting was adjourned. December 7, 1942 ATTEST: NO. 322 Office of the County Commissioners, Washington, Pa., November 27, 1942, Board of County Commissioners in regular session, those present being Messrs. Berryman, Cummins and O'Neil. Motion duly made and seconded that Ralph N. Lincoln, Project Engineer, Work Projects Administration, Washington, Pa., be notified of the suspension of operations at the end of the present pay period in connection with V'A Project 25733 Unit No. 6305, Mahan Bridge, Buffalo Creek. Potion carried, and the Chief Clerk instructed to forward a copy of this action of the Board to Mir. Lincoln. There being no further business before the Board, the meeting was adjourned.
