O'NEIL COMMISSIONERS Office of the County Commissioners, January 29, 1938, Washington,, Penna. January 29, 1938, the Commissioners in regular session. Members present Messrs. John D. Berryman, Earl B. Amos and John N. OtNeil. On motion duly made and seconded, the following Resolution was unanimously , adopted: WHEREAS, the Shoup Voting Machine Corporation did file a Performance Bond in the amount of $13,108.38 and a Main- tenance Replacement and Infringement Bond in the amount of $13,108.38 (in which Indemnity Insurance Company of North America was Surety) to guarantee the performance of their contract to furnish twenty-five voting machines to the County of Washington; and WHEREAS, by virtue of certain agreements thereafter made and entered into between the said Shoup Voting Machine Corporation and the County of Washington by reason of a referendum vote of the voters of Washington County, and by further reason of a bill in equity filed in the Courts of Dauphin County of this State., it was mutually agreed that the said contract for the purchase of said machines would not be enforced and could not be executed and would no longer be considered as binding upon the said County of Washington; and WHEREAS., by reason of the said facts and that the -said Shoup Voting Machine Corporgtion can not perform the -gaid contract and will not be permitted to perform the said contract with the said County of Washington, and that therefore there no longer exists any legal reason or neces- sity to retain the performance bond filed as aforesaid, and WHEREAS, the said Shoup Voting Machine Corporation has again recognized that the said contract for the purchase of the said twenty-five voting machines is no longer in legal effect, and has requested the return of the performance bond afore- said, and in consideration of said return has agreed by their letter dated January 3, 1938, to waive any and all claims against the said County. NOW THEREFORE, be it RESOLVED, that in consideration of the foregoingx and Maintenance Bond the aftresaid performance bond/of the said Shoup Voting Machine Corporation and of the Indemnity Insurance Company of North America be surrendered .and returned to them. There being no further business before the meeting, it was adjourned. (SIGNED) COUNTY COMMISSIONERS.
