BARNES, COMMISSIONERS 4- 1-32 WARD PRWIN2&0_56502 Office of the County Commissioners, Washington, Pa. , April 9, 1934. Commissioners in regular sessions members present being Messrs. Johnston* OtNeil and Barnes. The following Resolution was presented, duly seconded., and adopted: WHEREAS David Walker is now owner of the properties of the Hanover Coal Company of Pennsylvania and the Hanover Coal Coftany of Ohio situate in Hanover and Jefferson Townships, Washington County,, Pennsylvania, and has made a royalty lease of the same to W. S. Lockhart of McDonald, Pa. , dated March 13, 1934, said properties being fully de4dribed- ins aid lease and upon the terms and conditions therein set forth, all of which are made a part hereof* AND WHEREAS, there are taxes now due and payable to the said County against said properties, AND WHEREAS, it is, proVided in said lease that the royalties due thereunder shall be applied by the said 1"seetU the payment of all taxes now outstanding and due and all taxes hereafter levied and to become due and said lessee had re- quested the County in consideration of the agreement that the said royalties shall be paid in discharge of the said taxes, as aforesaid, not to proceed to collect said taxes by tax sales. NOW, THEREFORE, all members being presents it was unanimously resolved that in consideration Of the said agreement to pay and apply the royalties as aforesaid to the discharge of the said taxes, the said County hereby agrees not to prod*ed to collect said �qzes by tax sales so long as the said taxes are paid out of the Foyalties accruing under said lease, as aforesaid, but in the event that default ti is made in the payment of the said royalties to the discharge of said taxes, as aforesaid, then the County reserves and shall have the right to proceed to collect said taxes in the manner provided by law. There being no further business before the meeting, it was adjourned* (SIGNED COUNTY CMIMIONERS.
