BARNES, COMMISSIONERS 1.32 WARD PRINTING CO 56502 7- Office of County Commissioners, Washington, Pa. , May 3, 1934. Commissioners in regular sessions members present being Messrs. Johnston, O'Neil and Barnes. The matter of the contract for the twenty-five (25) voting machines with the General Sales Engineering Corporation having been presented to the Board for con- sideration, Meyer Goldfarb, Esq. , Attorney for the General Sales Engineering Corporation, appeared before the Board and requested the Board to make some die- position of the matter of the extension of the time for delivery of the machines under the notice from the Corporation, dated April 13, 19349 After consideration and di-suussion of the matter, it appearing that under the notice given the machines would not be delivered until May 71 1934, and it appearing to the Commissioners that this would not give sufficient time to instruct the custodians, the election officers and the voters in operating and handling said machines for the coming Primaries, and it further appearing that a petition of the electors has been filed to discontinue voting machines and that this question under the law will be sub- mitted to the voters at the general election of 1934, and it further appearing that the Bill in Equity filed by R. L. Munce, et al against the Secretary of the Common- wealth in the Common Pleas Court of Dauphin County, praying the Court to issue an injunction restraining him from purchasing the additional One hundred and fifyy (150) machines is pending, THEREFORE upon motion by Mr. Barnes, seconded by Mr. Johnston,, it was RESOLVED, That in the event that the Common Pleas Court of Dauphin County, in the proceedings aforesaid, result in an adjudication restraining the Secretary of the Commonwealth from awarding a contract for the purchase of the One Hundred and fifty (150) additional machines until and after the election in November, 1934, then this contract and the delivery of the machines involved therein shall be held in abeyance until after the result of the election in Ndivember, 19340 is obtained, and in the event that the electors in that election vote to discontinue voting machines in the County then the contract with the General Engineering Corporation is to be canceled and rescinded; in the event that the electors, at the election in November, 1934, vote to continue the use of machines then the time for delivery of the twenty-five (25) machines by the General Sales Engineering Corporation is to be extended to January 15,, 1935, and the terms of payments as provided for in the contract, are to be extended accordingly; RESOLVED FURTHER, That in the event that the proceedings in the Dauphin County Court do not result in an adjudication restraining the Secretary of the Commonwealth then the time for the delivery of the twenty-five (25) machines by the General Sales Engineering Corporation is to be extended to September 1, 1034, and the pay- ments as provided in the contract are to be extended accordingly, and that a supplemental contract be executed, to be signed by this Board and the General 159 � MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA J. Barnes and Johnston; voting "No", Mr. O'Neil, for reason of failure in delivery of the machines under the terms of contract, and there should have been immediate action on the part of the Board for cancellation of the contract.
