BARNES, COMMISSIONERIS Office of County Commissioners * Washington, Pa. , June 51 1928. Commissioners in regular session, members present being Iressrso Walker, Johnston and Barnes. The following Resolution was duly presented, seconded and adopted;-- WHEREAS, in the relocation and improvement of a section of State Highway Route No. 1,08 between Mapleview and the Hill Church through farm of R. L. Munce, North Strabane Township, it has 1peen found necessary to demolish or remove to a new location a frame barn on the South West part of said farm and believing that the said barn can be removed and placed upon a new location at less cost and damage than would result from demolishing the same, now, therefore ,, BE IT RESOLVED, that the County of Washington, through the Board of County Commissioners , hereby authorizes the proper officers of said County, to enter into an agreement with R. L. Munce for the removal and relocation of said barn and to pay to the said R. L. Munce the sum of $1379.00 as an award of damages , eta. , the- said Agreement, when prepared, to be signed by the County, Commissioners and the said R. L. Munce , parties thereto , the Agreement to be form and effect as follows ;- T H I S A G R E E M E N T MADE and ENTERED into June 5th, 1928, between the COUNTY OF WASHINGTON by J. E. TOHNSTON, J. W. WALKER, and IV. A. BARNES, County Commissioners , party of the first part, and R. L. MINCE of North Strabane Township, Washington County, Pennsylvania, party of the second part : WHEREAS in the relocation and improvement of a section of State Highway Route No. 108 between Mapleview and the Hill Church through farm of R. L. Munce, North Strabane Township, 'Washington County, Pennsylvania, it has been found necessary to demolish or remove to a new location a frame barn on the South West part of said farm; AND WHEREAS the parties hereto believe that the said barn can be re. moved and placed upon a new location at less cost and damage than would result from demolishing the same; MINUTE B- oOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA JAMES W. BARNES, COMMISSIONERS WARD i65 F_ PRINTING CO. 1 AND WHEREAS the County of Washington, acting through its County Commissioners aforesaid, has requested the party of the second part to remove and relocate the said barn, which the party of the second part hereby agrees to do, in consideration of the cost of such removal being allowed and paid to him by the County of Washington in the determination of the damages resulting to him from the construction and relocation of the said road; NOW THIS AGREEMT WITNESSETH, that the party of the first part hereby covenants and agrees with the party of the second part that in the determination of the damages to the Party of the second part, arising from the relocation and reconstruction of the said road, the sum of Thirteen Hundred Seventy-nine ($1379. 00) Dollars , the said sun being the lowest cost of removing and relocati the said barn, ascertained after competitive bids received by the party of the second part, shall be allowed and paid by.,,the party of the first part to the party of the second part as an element of such damage, and the party of the first part further covenants and agrees , in consideration of the removal and relocation of said barn by R. L. Munce, to concede and admit .in any proceeding to ascertain and determine damages by Board of Viewers or trial in Court that the said party of the second part, his weirs and assigns , is entitled to re- ceive an award in the said sum of Thirteen Hundred Seventy-nine ($1379*00 )Dol- lars , without in any way affecting any other or additional claim the party of the second part may have by reason of the relocation and improvement aforesaid.
