WHEREAS, William Marietta and Marjory Marietta, his wife,
of Fallowfield Township, Washington County, Pennsylvania, are the owners
of Lot No. 10 in the Bleanora W. Patterson Plan of Lots , situate in
Fallowfield Township* Ttashington County* Pennsylvania, recorded in Plan
Book 2, Page 46, Washington County records , fronting eighty-three and
thirty-seven hundredths (83-37 ) feet on Boyle Avenue, and adjoining Lot
No. 9 on the south, and Davis Street on the North and a ten foot alley
at the rear- upon which is erected a two story frame dwelling consisting
of rooms ; and
WHEREAS, said Boyle Avenue has been taken over by the Common-
wealth as the state highway and known as Route No. 247, and the said State
Highway Department has relocated and extended the lines of same so as
to extend through said Lot No. 10 and through the said house erected
thereon; and
Whereas , the said State Highway Department has let a contract
for the said relocation changing the grading and constructing of said
highway as aforesaid and the contractor is on the ground doing said work;
and
'i"THEREAS, the County of Washington, under the law, is liable
to pay the damages to the land owners caused by the taking of said
property as aforesaid, and by reason of the contingency that has occurred
and the necessity for the immediate removal of the said building upon said
lot, the County of Washington by its commissioners have deemed it proper
and expedient to agree with the said owners of the said lot for the dam-
ages arising to them by reason of the necessity for the removal of said
building from said lot, and that said owners have agreed to remove the same
instead of allowing it to be demolished.
NOW THMMFORE, the above named William Marietta and Marjory
Marietta, his wife, for and in consideration of the agreement,of the
County Commissioners aforeaaid to pay them the sum of Twenty:qne hundred
seventy-five dollars ($2175. 00) as hereinafter set forth, hereby covenant
and agree to proceed at once and immediately remove the said building from
said premises , gree and clear of the right of way for said State highway;
in consideration thereof, the said County of Washington, .by its com.-
missioners aforesaid, hereby agree to pay to the said William Marietta and
Marjory Marietta, his wife, the said sum of twenty"ane hundred seventy-
five dollars (32175-00) when said building has been removed as aforesaid.
It is further understood and agreed between the parties hereto
that the payment of the said sum of 2175.00 as aforesaid, include all

damages of any kind, for or on account of the removal of the said building,
or for or on account of any damages to the building whatsoever; also any and
all da-ages to the cistern on said lot; and also any claim for damages, to lots
Nos . 19 and 20 in said plan immediately across the alley. But any other claim
for damages to said lot which may be legally recoverable from the County in
connection with the improvement of a state highway, shall be submitted t the
.6oard of Vidwers for their determination.
It is further understood and agreed, and tAe said William Marietta and
Marjory karietta, his wife, do hereby warrant that they are the AnamrsiAn fee
simple of the premises hereinabove described and that the same is free and clear
of all liens and encumbrances ; and in the event of there being any defect in
title or any lien or encumbrance on said premises , the County of Washington
may retain and withhold from said payment such amount as will be sufficient to
amply and fully protect and indemnify the Oounty of Washington from any loss
whatsoever.

For and in consideration of the covenants and agreements in the contract
entered into by us this day with R. S. Moodey, of the -Borough of Oharleroi ,
Washington County, Pennsylvania, for the removal of the foregoing building, we
hereby assign, transfer, and set over to the said R S Moodey the above sum of
Twenty-one hundred seventy-five dollars ($2175-00) and we hereby to endorse
the warrant for the same to be issued by the County Commissioners to R S Moodey,
and the same to be so endorsed payable to the said R. S. Moodey when we certify
to the County Commissioners that he has fully completed the said contract with

Lots Nos. "B" and tic in the Plan of Wilson Heights , laid: out by Jacob
Zeidman* situated in Fallowfield Township, Washington County, Pennsylvania,
recorded in clan Book 5, page 172, Washington County records , which said lots
front one hundred thirty-five (135) feet on the Monongahela Road and ex-
tend back to Johnson Street in said -Plan and line betwwen Wolf Avenue and
property now or formerly of Hamilton Johnson; upon which is erected a two
story frame dwelling together with other out-buildings ; and

Cowmonwealth as a state highway and known as Route No. 247, and the ' aaid
