Followin resolution was g presented by )tr. Johnston, duly seconded
by Mr. Acker. Question being called for the follbwing vote was recorded;
favoring its adoption, Messrs. Johnston and faker; Resolution adoptot -

and Thomas Hill, Commissioners, did by agreement dated June 27th, 19190
award to Federal Construction Company, a Corporation, contract for the
construction and improvement of a portion of the road extending from
Burgettstown to -bulger beginning at the eastern borough line of Burg*ttstow,
and extending a distance of 1.70 miles.
AND VMEM S, the said Federal Uoustruction Company, in accordance,
with the provisions of the said contract did furnish to the County st
Washington its bond for the faithful performance of the said contract -with
the Globe indemnity company as surety thereon.
AND WHSPJW, the gtder&X Construction Company comoruated atadf-oas,r-
pleted, 'portion of the said road 4%tt has been unable vho.ly to camp&Oto
the same and the Globe Indemnity Company at its own cost and expense ham%'
procured an assignment of the said contract to tke made by the Federal,
Construction Company to George a. "Cottle, coward A, Cottle And T. DO
Gladden, trading as Cottle & Gladden, of MoDcnAJt, ;'"ennsylvania,
AND 1MWM,, the assignment of the said contract has been appre ,
and accepted by the County Commissioners of Washington County and tl&

NOW TH3'REFORN BB IT RBSOLVND, That the County of Washington, by
d, W. Walker, J, B, Johnston and W,. H, Ncker, County Commissioners,
does hereby release, discharge and acquit the globe Indemnity Company
from any and all liability upon its bond aforesaid and from any and
all liability it may have upon the said bond or by reason of the failure
of the Federal Uonstruotion company to comply with the terms and conditions
of its contract, except that this release shall not apply to nor relieve
the Globe Indemnity Company from any liability ihich any have already
arisen on the said bond on claims of material men or laborers and shall
not relieve nor release the Globe Indemnity Company from any liability
on the said bond on account of any defective construction of any part '
of the said road already completed by the Nederal `onstruction Company

which shall be noticeable or discoverable on or before one year after
I the completion thereof, and shall not relieve nor release the said Globe
Indemnity Company from any liability for damage or injury to any person
I

Construction Company which liability shall have attsohed or become fixed

of the said County of Washington, in the Borough of Washington,
Pennsylvania, on the fourteenth day of March, 1921: all of the members
of said Board, to wit, J, S, Johnston, J. W. Walker and W. He Boker+
being present, the following Resolutiop wads on motion duly made and
seoonded, unanimously adopted by said Board, to wit;
whereas, By virtue of and in accordance with the provisions
of the Act of the General Assembly of the Commonwealth of Pennsylvania,
approved the 12th day of June, 1919 (Pamphlet Laws page 450) and the
