Pa. , ,May' 21, 19 23, At a meeting of the Board of County Commissioners of the County of Washington in the State of Pennsylvania, duly called and held at the office of said Board of County Commissioners at the Court House of the said County of Washington, in the Borough of Washington, Pennsylvania, on the 21st day of May,, 19 23 , all of the members of said Board, to wit, J. W. Walker, J. E, Johnson and W, H. Ecker, being present, the following Resolution was, on motion duly made and seconded, unanimously adopted by said Board, to wit; WHEREAS, by proceeding had in the Court of Quarter Sessions of Washington County, Pa„ in accordance with the provisions of the Act of the General Assembly of the Commonewealth of Pennsylvania, approved on the llth day' of May, 1911 (Pamphlet Laws, page 244) and the amendments thereof and supplements thereto, the improvement, construction and maintenance under the said Act of divers sections of the main -public roads in said county has been authorized and ordered and decreed to be done; and WHEREAS, the County Commissioners of the said County propose to ro- p 7 , coed, during the year, 1923 , to build, repair, maintain and otherwise permanently M -INUTE ® CEO BOAR® OF COUNTY COMMISSIONERS !P`,/ASHINGTON COUNTY, PENNSYLVANIA J ELMER JOHNSTWT, JAMES W WALKER, W H ECKER, COMMISSIONERS improve a pa , of which has been authorized and directed as aforesaid, and in order to provide for `the cost of the building, repairing, maintaining, and otherwise permanently improving the same, it is necessary to borrow upon bonds to be issued by the said `county the sum of One Hundred Sixty-five Thousand ( $165,000.00) Dollars, the funds now in the treasury of the County, and those to come in during the said year ( from sources other than such borrowing) not being sufficient to defray such 'cost. NOW THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS 6Y the said County of Washington, that for the purpose of providing for the cost of the building, repairing, maintaining and permanently improving the public roads and highways now constructed or to be constructed by said county, so as aforesaid authorized and ordered and decreed to be done, the said County do borrow the sum `of On's Hundred Sizty-five Thousand ( $165,000.00) Dollars and in- crease its indebtedness by the issue of One Hundred Sixty-five bonds in the denomination of One Thousand ( $1000.00) Dollars each, to be numbered from one to one hundred sixty-five ( 1 to 165) , both inclusive, to bear date the first day of July' 19 23 , and to bear interest at the rate of four and one-half ( 4j) per cent per annum from their date, payable semi-annually on the first days of January and July in each year, 'both principal and interest being payable, free of any taxes required to be paid or which may be hereafter required to be paid under any law of the Commonwealth of Pennsylvania, said county expressly agreeing and assuming to pay the same. This bond may be registered as to principal only upon the bond registry book to be kept at the office of the County Commissioners of Washington - County, and by endorsement upon the back hereof by the Clerk for the time being for the County Commissioners, after which no, -transfer of this bond shall be made except by the registered holder or holders in person, or by their duly authorized attorney, and such transfer shall be noted upon the bond registry book kept at ;the office of the Commissioners of Washington County, and upon the back hereof, provided, however, that this bond may be transferred to bearer, and negotiability thereby restored, and shall continue subject to registrations or transfers to bearer, but no such registration of principal shall affect the negotiability of the coupons hereto annexed, which shall continue to be transferable by delivery only, This bond may also be registered both as to principal and in terest, in which event the coupons hereto attached shall be detached and imme- diately, aancelled by the Clerk for the time being for the County Commissioners of Washington County, and such registration shall be noted upon the bond registry book kept at the office of the County. Commissioners aforesaid, and upon the back ; hereof, and thereafter the semi-annual interest shall be paid to the holder or holders hereof by check or warrant drawn to the order of the registered holder or holders hereof, and mailed to his, her or their address, as the same appears of record upon said bond registry book. This bond is one of a series of one hundred and sixty-five ( 165) bonds, of like date, tenor and effect, amounting in the aggregate to One Hundred Sixty-five Thousand Dollars ( $165,000.00) , issued for the purpose of provid ing for the cost of the building, repairing, maintaining and otherwise permanently improving the public roads and highways now constructed or to be constructed by said county, pursuant to the, authority conferred by the Act of the General Assembly of the Commonwealth of Pennsylvania approved the llth day of May, 1911 (Pamphlet Laws, page 244) and the Act of -the General Assembly of the Commonwealth of .Pennsylvania approved the 20th day ,of April, 1874, ( Pamphlet Laws, Page 54) , and Acts Amendatory thereof and supplemental thereto, WA by virtue of a Resolution i 7t`3 MINUTE BOOK BOAR® OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA J ELMER JOHNSTON, JAMES W WALKER, W H ECKER, COMMISSIONERS of the County Commissioners of said County, adopted at a meeting thereof duly called and held. It is hereby certified and recited that all sets, conditions and things-necessary to the validity of this bond, exist, have happened and have been done; that every requirement of law affecting the validity hereof has been duly complied with; that this bond is within every debt and other limit pre- scribed by the constitution and laws of the State, and that prior to the issuance thereof an annual tax has been levied in a sum sufficient to pay the principal and interest of this series of bonds. The faith, credit and property of said County of Washington are hereby irrevocably pledged to the punctual payment of the principal and interest of this bond in accordance with its terms. BE IT FURTHER RESOLVED that the Controller of said Washington County be ordered and directed to advertise said bonds for' sale in accordance with the- provisions of the Act of the General Assembly of the Commonwealth of Pennsylvania, approved the 6th day of July, 1917 , and the Acts amendatory thereof and supple- mental thereto, and that the same be sold to the highest responsible bidder- after due public notice as required by said Act, Provided that no bid for said bonds at less than their par value shall be accepted: AND BE IT FURTHER RESOLVED That said One Hundred Sixty-five Thousand ( s 165,000.00) Dollars of bonds, when duly prepared, signed and sealed in the form above set forth, shall be delivered to the purchasdre thereof, as herein- above provided, on payment of the purchase price thereof, and the receipt of the Treasurer of the said County shall be to the purchaser a full acquittance for the said purchase price, and the said purchasers shall not be bound to see to the application of the proceeds thereof.
