HomeMy WebLinkAboutCOMM - Meeting Minutes - PB 7-16-14 - 7-16-2014 - PRISON BOARD29 MINUTE BOOK PRISON BOARD WASHINGTON COUNTY, PENNSYLANIA [MR LIMITED E1316649LD Minute No. PB 7-16-14 Washington County Prison Board Washington, Pennsylvania, July 16, 2014 The meeting of the Washington County Prison Board was held in the 7th floor conference room, Courthouse Square, Washington, Pennsylvania, with the following members being present: Commissioners Larry Maggi, Diana Irey Vaughan and Harlan G. Shober, Jr.; Controller Michael Namie; and Sheriff Samuel Romano. Also present: Warden John Temas; Solicitor J. Lynn DeHaven; Human Resources Director Kathleen Bali; Chief Clerk Mary Helicke; Administrative Assistant Joyce Thornburg; .Assistant District Attorney Joe Zupancic; Attorney Edmond R. Joyal, Jr., of the Law Office of Joseph S. Weimer; and Observer -Reporter representative Barbara Miller. Chairman Maggi called the meeting to order at approximately 11:35 a.m. Chairman Maggi asked if there were any corrections, additions or omissions to Minute No. PB 6-18-14, each member having received a copy. It was moved by Mr. Namie and seconded by Mrs. Vaughan that Minute No. PB 6-18-14 be approved. The motion was carried unanimously with the Board signifying their approval by stating "Aye". PUBLIC COMMENTS None, WARDEN'S REPORT Warden Temas presented the following information to the Board: Income from other units for the maintenance of prisoners for Lune 2014 Administrative Fee $2,858.87 Social Security $2,800.00 Tylenol -0- Monthly sub -total $5.658.87 Year-to-date grand total $20,647.22 Program Fees and Room and Board Income for Tune 2014 Billed Collected Work release $10,418.12 $9,809.12 Weekenders $550.00 $600.00 Turned over to Clerk of Courts (minus) -0- Adjustments made to billings (minus) -0- Monthly sub -total $10,968.12 $10,409.12 Year-to-date grand total $63,374.60 $63,396.60 Status of prisoners confined at the end of Tune 2014 Males Females Total Full time 70 7 77 Work release 31 2 33 Weekend prisoners Unsentenced prisoners awaiting sentencing and/or trial 3 185 0 47 3 232 Total prisoners 289 56 345 Males Females Total Examinations performed by the physician 34 21 55 New commitments 11 Repeat patients 44 Medical transports performed by the Sheriff 26 30 MINUTE BOOK PRISON BOARD IMR LIMITED E1316649LD WASHINGTON COUNTY, PENNSYLANIA Warden Temas recommended the Board approve to extend the contract for inmate telephone services to Inmate Telephone, Inc. (ITI), Altoona, Pa., through August 13, 2016. ITI offers the highest commission with the lowest rates to the inmates and their family. The commission percentage is 52%. All hardware and software is provided free of charge. This extension is contingent upon approval of the Board of Commissioners in a meeting to be held Thursday, July 17, 2014, Minute No. 974. Warden Temas recommended the Board approve to extend the current contract for elevator maintenance for all county facilities to Otis Elevator Co., Pittsburgh, Pa. This contract extension will be effective July 14, 2014 through June 30, 2015, at a 5% discount from prior year. This contract extension is under the same terms and conditions as the original contract and is contingent upon approval of the Board of Commissioners in a meeting to be held Thursday, July 17, 2014, Minute No. 974. It was moved by Mr. Shober and seconded by Mrs. Vaughan to approve the Warden's Report. The motion carried unanimously with the Board signifying their approval by stating "Aye". BILLS Mr. Namie presented to the Board for their consideration and approval the bills dated July 16, 2014, in the amount of $65,440.17. It was moved by Mr. Namie and seconded by Mr. Shober to approve the bills dated July 16, 2014. The motion carried unanimously with the Board signifying their approval by stating "Aye". (See list of bills attached hereto and made a part hereof.) OLD BUSINESS None. NEW BUSINESS Edmond Joyal, Jr., who represented the County in a federal case brought by David D. Wise of Washington, over alleged mistreatment at the Washington County Correctional Facility, updated the Board on the case. A jury found that the Correctional Facility had not mistreated Mr. Wise and following the verdict, Mr. Joyal filed a motion for sanctions against the attorney and the law firm that represented Mr. Wise's case for discovery rule violations. The law firm settled and signed a release with the County for $10,000 which will be applied toward the county's $25,000 deductible. Mr. Joyal stated that one of the firm's attorneys did not sign the release and therefore, Mr. Joyal will be filing a separate motion for sanctions against the attorney who did not sign the release. He went on to say that he hopes to get a written opinion from the judge who ruled in favor of the request for sanctions. He hopes this will put attorneys and firms on notice regarding these types of suits, especially where the demands are at $1 million at pre-trial, will not be tolerated. Mr. Joyal noted that there is a similar case against the Correctional Facility that will go to trial in October. Mr. DeHaven noted that Travelers Insurance is covering Mr. Joyal and his firm's work on this at no cost to the County.
