Commissioner Diana Irey Vaughan led the meeting with a prayer. Commissioner Larry Maggi led the Pledge of Allegiance. Mrs. Vaughan thanked everyone for coming. Before they begin the public comment period, she wants to clarify some issues related to today's vote for an ordinance under consideration on a Government Study Commission. The ordinance reads as follows: "Shall a Government Study Commission of 11 members be elected to study the existing form of government of the municipality, to consider the advisability of the adoption of an optional form of government or a home rule charter, to recommend the adoption of an optional form of government, or to draft a recommend a home rule charter?" Today's vote for the ordinance is only to place the question on the November 2nd ballot allowing the voters of Washington County to decide if they wish to pursue a study or not. It does not immediately initiate a government study. Rather Washington County voters will be tasked with deciding: • whether or not a Government Study Commission is formed. If the Board of Commissioners passes the ordinance today, the question will be placed on the November 2nd ballot, to be answered "yes, we'd like a study" or "no, we don't want a study" • who will serve on the commission. If the Board of Commissioners passes the ordinance today, anyone wishing to serve on a potential Government Study Commission may circulate nomination papers. Individuals who meet the qualifications to serve will also be placed on the November 2nd ballot, allowing voters to choose the Government Study Commissioners they want. In today's social media environment, it is important to research information carefully to determine what is fact and what is fiction. Some in our society have developed a sense of entitlement to make public statements of distorted truths and unfounded accusations. Our country's trend of divided politics is creating doubts and fears of government corruption in an effort to dismantle and disrupt government processes. This approach is proving to create confusion for constituents, manifesting in an all-time high distrust in government and its leaders. 1782 MINUTE BOOK BOARD OF COMMISSIONERS WASHINGTON COUNTY, PENNSYLANIA In Washington County, we cannot allow special interest groups or political party leaders to dictate how the county government operates, that must be up to you, the people. For many years, Washington County has been used as an example of good government —our elected leaders working in a bi-partisan and respectful manner for the benefit of our county and its future. This has always been further complimented by our diverse and hardworking staff throughout the county, who have a passion for public service. As the Board of Commissioners, it is our elected duty to uphold our oath of office and do what is best for the citizens we were elected to represent. After all, that is what you, the voters, elected us to do. To clarify a few recently published misconceptions: • The notion that a Government Study Commission will result in a power grab by having one county executive. This is false. There are multiple options on how to create a new leadership structure, if the voters choose to create a commission, including retaining our three -member board of commissioners. If the citizens vote in favor of a voter -elected Government Study Commission the commission will only recommend to the voters of Washington County what changes, if any, should be made. Let me stress here ---the Government Study Commission does not MAKE changes in our government structure. They SUGGEST changes, and then the voters again decide, this time whether they like the suggestions or not by again casting their vote. In 2001 the last voter elected Government Study Commission recommended no changes. The ultimate decision lies with you, the voters. • The notion that a Government Study Commission will be a huge financial burden to taxpayers. This is also false. As a reference, the last study, which was conducted in the early 2000s, cost taxpayers a little over $4,000. Even accounting for inflation, the expenses will be both justified and reasonable. Additionally, if the Government Study Commission were to recommend consolidation of function in some areas, there is the potential that taxpayers could save a considerable amount annually. • Suspicion and false conjecture about why the issue is being raised at this time. As we all know, in 2019, an audit of the Clerk of Courts office discovered over $97,000 in missing funds. After turning the matter over to authorities, the county cooperated with the Court to divert necessary resources to swiftly safeguard the Clerk of Court's financial operations. Frustratingly, the County was left powerless to take any further action as the matter progressed through the investigative and judicial processes. The limitations County officials experienced in responding to the crimes of an elected Clerk of Courts ensured that the issue of effective governance would come up at the next available opportunity. This issue was first discussed publicly at the NAACP candidate forum in September 2019. The topic of a Government Study Commission was posed to every candidate who participated as a result of the Clerk of Courts incident. This topic warranted further discussion due to the constraints experienced by the County and its limitations to respond to the incident accordingly. • On January 15`h of this year, the Court issued an unprecedented administrative order on court procedure, due to the many deficiencies made in the court filing offices that were badly hampering basic county judicial processes. In my 25 prior years of service, the only Administrative Order from the Court, directed to a row officer, was the Clerk of Courts when a theft occurred. Given the gravity of the situation, the Board of Commissioners first met on January 21" to engage in a discussion on a potential Government Study Commission. Since then this Board of Commissioners has continued to discuss this issue as more concerns have been brought to our attention. • Unfortunately the court was required to enter additional orders to administer justice on May 7th, 28th, July 1st, 6th, and 22nd. The court filing offices' inability to maintain basic court system standards, impeding due process, is a further reason to address effective governance now. The opportunity to present this question to the taxpayers for review of our form of government is now. We have a unique opportunity for the electorate of Washington County to have a greater voice in how their county will operate into the future. There is no doubt that a Government Study Commission will be a complex task. Its voter -elected members must extensively review and examine our current form of government and decide if changes should be recommended to better meet the needs of our growing county. Then the electorate of the county will have the opportunity to vote on the recommendations made by the commission. In summary, this is not about the government growing larger, government officials grabbing more power, or government bilking taxpayers. It is about government being effective. I have spent the last 26 years of my life serving the residents of this county and over that time, I have listened to your concerns with LJ n 1783 1 MINUTE BOOK BOARD OF COMMISSIONERS WASHINGTON COUNTY, PENNSYLANIA one purpose in mind —to provide only the best service of government for this county. I believe you did elect me to do the right thing and to vote my conscience. Passing this ordinance today will allow you the taxpayers to decide: • if a Government Study Commission should be established to review our form of government. • provide you with the opportunity to elect who should study our form of government if the majority of our voters pass the ordinance. As is our longstanding policy each resident or taxpayer of Washington county will be permitted to speak for three minutes. I welcome this opportunity for all residents to become fully engaged in the process which will allow your voice to be heard. Mr. Rens just found out that in 1976 the Home Rule Charter was also brought up and spent 20 months studying county government, proposing a charter and this was totally rejected by the voters. In 2001 this came up again. Mrs. Vaughan was on the committee and spent an additional nine months studying our government, and again it was decided that no changes be made. Mr. Rens stated why again are we spending time studying this? He is asking the Commissioners to please postpone this vote. Susan Priest stated she supports a government study for Washington County. She went on to say that we had a crook in Washington County (Clerk of Courts, Frank Scandale). We all knew this and yet nothing could be done to remove him shows the system is flawed. We are only making suggestions to improve government. She urges the Commissioners to go forward, study this, and offer the voters a choice. Priscilla Argentine of McMurray, stated she is in favor of the Government Study Commission. She stated the Republicans have clawed their way through an election to elect two Republicans. When one party rules for decades, it's easy to become complacent. Drain that swamp, stop the spending, and stop favoring the lobbyists that line their pockets. They want lady justice to be flying. Ms. Argentine stated this Home Rule Charter is not coming from the people of Washington County. She stated this would eliminate row offices and it is these offices that are exposing practices that do not add up. Ms. Argentine made the remark that this 'J 1 1785 L MINUTE BOOK BOARD OF COMMISSIONERS WASHINGTON COUNTY, PENNSYLANIA is coming from two of the Commissioners that have been in power for decades. She asked the Commissioners why they want to stop offices. She said rather than Home Rule, it's time for term limits. Bonnie Heslop is the average voter. She stated she gets in and out of voting. Ms. Heslop stated she does not understand the Home Rule. She asked how do you vote on it when you do not understand it? It is never a good idea to centralize government and it is too much power. Ms. Heslop said it sounds like Home Rule Charter is making a drastic change to get the people out of the row offices. Tamara Sampson of North Strabane, stated she really doesn't know what is going on with the Home Rule Charter rule but she asked to give them time to study this. She doesn't know if she is for or against it, and this is your average person. Bob Sabot of North Franklin Township is here representing himself as a taxpayer and not a North Franklin Supervisor. He stated he doesn't understand why people would be opposed to putting an item on the ballot to form a commission, spend perhaps $5,000 or $6,000, at the most, to make a determination to make a recommendation back to the county. Mr. Sabot stated all these letters stating there is no involvement by the voters is simply not true. He mentioned the fact that everyone is not happy with spending a few thousand however you do not have a problem with spending perhaps $3 million to decertifying new voting machines. Mr. Sabot suggested that all elected officials stay out of this process. This should be independent people. He stated we need to study and look at this. Ann Shaner of Peters Township, a Home Rule community, says the people complain they have no power. This Home Rule gives the people some power. Mr. Dave Ball resides in this township and is chairman in this township. If you think your government is not doing something correctly, you can get a referendum on the ballot. Ms. Shaner also remarked you can go out and get signatures.. She stated this commission is not compensated and does not get paid. Ms. Shaner stated you have to start August 3 through August 24, to get signatures on a petition, to study whether we should do this. She remarked she went on the Republican website and the remarks people were making, made no sense. Commissioner Diana Irey Vaughan was not sent here to do what you want her to do. She is here to represent all of the people and to do what is in the best interest. Ms. Shaner actually has a five -page letter showing the messed up adoptions, and if you come up here and speak, you better know what you're talking about. She said you have to know what these offices do. Todd Pappasergi, Treasurer of the Washington County Bar Association, and this is a statement on behalf of the directors of the Washington County Bar Association. Mr. Pappasergi said the bar association is a non -partisan, non-profit organization comprising of 450 judges and attorneys in Washington County. Mr. Pappasergi also stated according to the bar association has an objective and non -partisan interest in the arrangement, conduct and management of the courthouse offices and the keeping of all public records of the county. He stated through the various committees the association makes itself available to assist the court and the county's row offices. He also stated per Pennsylvania statute, the purpose of the Government Study Commission would be to explore how the county may be strengthened or made accountable to the public. Mr. Pappasergi said these duties are ministerial and critical in nature and carry out the functions of the county. He stated therefore the Board of Directors of the Washington County Bar Association supports asking the citizens of Washington County to form a government study commission to determine where improvements, if any, should be made. Jenna Palmieri is opposed to forming a committee to study our form of government. She said this is a very sneaky and manipulative process without any time to educate ourselves or do research. Ms. Palmieri also stated these parties will be on the ballot without any mention of the party affiliation.. She feels this is a very dishonest policy. She also said the voter will have no idea who to vote for because they have not had the time to do research. Jim Roman, Register of Wills in Washington County. He stated that last week's meeting was probably postponed because it was illegal. Mr. Roman stated the meeting was probably illegal. He stated it was not on the Commissioners' page, Facebook page, website, and there is no transparency by these Commissioners. Mr. Roman stated if this was such an important issue, why rush this? He said less than 20 years ago, Home Rule was voted down. Mr. Roman mentioned there has been no change in the population, and the population has shifted from Democrat to Republican. He said Washington County citizens voted for change less than two years ago when they voted for republican candidates. Two of the three Commissioners have not stepped foot in the Register of Wills office. He stated he has not seen one complaint but has seen complaints in the newspaper. He asked if anyone remembers the $300,000 missing because of the food pantry problem? Or the Auditor General's report stating that $1.5 million is missing because of the Community Service program? Plus, in addition, the $1.3 million that the county has that belongs to the state and has been misappropriated, according to the Attorney General. Lars Lange, a West Beth Township Supervisor, stated he appreciates Mrs. Vaughan's explanation of the Home Rule process. He believes this is a good process for the general population to see how the government works. Mr. Lange does not see any ulterior motives, and believes this will force the public to get more involved. He supports this initiative. Kris Zucop of Canonsburg is against the Government Study Commission. She said uneducated voters need time to figure this out. And she has found that uneducated voters in this area is a disease. Ms. Zucop alto stated that while doing research she has found that the Home Rule has cost more money. In a study by the Journal of Regional Analysis and Policy states that per capita for counties expenditures average $659 versus $974 in Home Rule counties. Taxes per capita average $165 versus $227 in Home Rule counties. We need to find ways to cut expenditures. Laura Hough, Prothonotary elected in 2019 and took office in 2020. She said she has received no emails or phone calls in over a year, even when she has reached out to them, including the Bar Association. Ms. Hough also stated she does have good news such as lots of programs in the Prothonotary's office. She also stated that in her office she has made progress and developed a new and accurate system for the processing of the Clerk of Courts judgment fees which were audited by the Washington County Controller since 2015, and were in excess of $90,000. She said these fees were not processed in a timely manner until she corrected the problem and any judgment fee processing was completed in seven months, and this was with the full cooperation of the Clerk of Courts, Brenda Davis. Ms. Hough also perfected existing filings and they are completely up-to-date for quite some time. Ms. Hough has added the actual images online which the users love. She also said the ability to print images and print was actually added in early 2020, along with real- time filing judgment images. Ms. Hough also stated that during COVID emergency, the ability to e-file was offered by this office. She said she has asked for meeting over and over again, and this has not happened. A resident of West Bethlehem Township stated he has sat back and listened to the line that it's up to the people. He stated this isn't a Communistic county, and if we have nothing to hide then we can have them vote. He said this is the problem in the County, there is too much bickering between two different parties, and if we have nothing to hide then we will have a committee to look into this. He stated Ms. Zucop said there was no time to study this and contradicted herself because she had stars. He cares about the future, kids and grandchildren. Brenda Inches of Burgettstown stated she doesn't know anything about this Home Rule Charter. She does not believe three months is long enough to educate people. She said maybe she is not doing her homework but she just does not know. She does believe she has seen any of these people come to Burgettstown and do a Town Hall meeting. She is asking to not put it on the ballot in November. Leann Marcolini of East Bethlehem Township, has worked as Judge of Elections. When there is a referendum on the ballot, people have no clue what this is, and nobody tell them. Ms. Marcolini comes from a small rural township with no computer access. Paul Everson stated he generally has no clue. He has looked up names and has done his research. If it is out there, he cannot find it. He said if these people come up on the ballot in November, he does not know who they are. Mr. Everson stated he would love to know who is on this commission, and would like to make an intelligent decision. Josh Barrett, an independent voter. There is obviously a flaw voting for this immediately. I am not opposed to this but the people do not know what this is. Mr. Barrett said to put this off and vote on it in the primary. He said the names on this would be the same people that hold offices and have the names of the people that already have a connection. Mr. Barrett stated that somebody like him would not have a chance to get their names on the ballot. His suggestion would be to hold off so people like himself would be able to get their names on ballot. Angela Carrier, a Cecil Township resident, and the treasurer of the Republican Party. She is an insider and knows of the personalities involved. Ms. Carrier stated the row officers are digging into some things that need to be dug into. Her suggestion would be to table this issue. Ms. Carrier suggested before meeting on this, sit down and have a good discussion. Brenda Davis, Clerk of Courts, stated it has only been seven weeks that the state auditor, Timothy DeFoor, held a press conference in Pittsburgh revealing the findings of the audit of 2016 through 2019 findings of the oral and observation page. The auditor revealed that the former Clerk of Courts apparently had an agreement with the Commissioners and Controller to not access and properly record fees in the state's mandated computer system. She stated that over $1 million subverted this from over the top of the Clerk of Courts office. This was before Frank Scandale had the opportunity to do what he is serving his penalty for. Ms. Davis stated she represented all the people. Ms. Davis has been impeded from following the law, and asked the chairwoman when were they going to follow the law. She found it ironic that a week ago the chairwoman wanted to follow Governor Wolfs side order but then a week ago, follow his side order on the voting machines. Ms. Davis stated she can not have it both ways. She stated the row offices are the keepers of taxpayers money. Ms. Davis commented that the Commissioners have to keep their hands out. NEW BUSINESS Chief Clerk presented to the Board for their consideration and approval, of an ordinance of the County of Washington, Washington County, Pennsylvania to determine the following question: Shall a Government Study Commission of 11 members be elected to study the existing form of government of the County; to consider the advisability of the adoption of an optional form of government or Home Rule Charter; and to recommend the adoption of an optional form of government or a Home Rule Charter. Moved by Mr. Maggi; seconded by Mrs. Vaughan, approving the ordinance. Roll call vote taken: Mr. Sherman — No; Mr. Maggi — Yes; Mrs. Vaughan — Yes. Motion carried unanimously. Chief Clerk presented to the Board for their consideration and approval, on behalf of Finance and the District Attorney, of an agreement with SPHS Care Center for the STOP Grant. The agreement is in the amount of $62,500 and will be for the period of January 1, 2022 through December 31, 2022. Moved by Mr. Sherman; seconded by Mr. Maggi, approving the agreement with SPHS Care Center for the STOP Grant. Roll call vote taken: Mr. Sherman — Yes; Mr. Maggi — Yes; Mrs. Vaughan — Yes. Motion carried unanimously. Chief Clerk presented to the Board for their consideration and approval, on behalf of Human Resources, of an agreement with Walsh, Barnes & Zumpella, P.C. for legal services to the county pertaining to employment related cases, civil rights matters, EEOC, PHRA claims and unemployment compensation cases. The agreement will replace the contract with Swartz Campbell, LLC for the same services and will be effective July 19, 2021 through December 31, 2022, and the rates will remain the same. • Attorney — $155/hour, Associate Attorney — $140/hour, Paralegal — $90/hour. Moved by Mr. Sherman; seconded by Mr. Maggi, approving the agreement with Walsh, Barnes & Zumpella, P.C. Roll call vote taken: Mr. Sherman — Yes; Mr. Maggi — Yes; Mrs. Vaughan — Yes. This agreement will be effective July, 1, 2021 through June 30, 2024, at a total cost of $6,077. The proposed agreement cost will be paid from Information Technology's operating budget.
