Mrs. Vaughan called the meeting to order at approximately 2 p.m. and announced that the meeting is video and audio live -streamed via Facebook. Pastor Michael Roach led the meeting with a prayer. Veteran Gary Elder led the Pledge of Allegiance. Mrs. Vaughan entertained a motion to approve Minute No. 1167, dated March 16, 2023. SPECIAL ORDER OF BUSINESS Mr. Sherman read a proclamation declaring April 2023 as Child Abuse Prevention Month. Moved by Mr. Sherman; seconded by Mr. Maggi, to approve the proclamation. Roll call vote taken: Mr. Sherman — Yes; Mr. Maggi — Yes; Mrs. Vaughan — Yes. Motion carried unanimously. Accepting the proclamation was Anne Schlegel, Director, Children & Youth Services, Managers Ashley Blake, Kristen Young and Hilary Burchett, along with Human Services Administrator, Kim Rogers. Ms. Schlegel said child abuse is a heartbreaking and devastating reality that affects too many county children. She pleaded for the citizens and organizations to work together to create a community where abuse is no longer tolerated. Ms. Schlegel called for a strengthening of our communities to support families in preventing child abuse. She took a moment to thank the individuals and organizations already working toward this goal. She recognized the everyday efforts of the caseworkers and managers of the CYS, calling them true superheroes. Ms. Lunger thanked the Commissioners for recognizing the importance of Early Childhood Intervention and therefore, positive parenting practices. She offered a message of support to her team's Early Interventionists who diligently serve children and families within our community, stating the importance of their life's work cannot be understated and the impact it has on our county's littlest residents is immeasurable. She said the county stands with the families in our community, in the development of our young children. Mrs. Vaughan read the proclamation declaring April 2023 as Autism Awareness Month. Moved by Mrs. Vaughan; seconded by Mr. Maggi, to approve the proclamation. Roll call vote taken: Mr. Sherman — Yes; Mr. Maggi — Yes; Mrs. Vaughan — Yes. Motion carried unanimously. Accepting the proclamation was Jennifer Scott, Administrator, Behavioral Health and Developmental Services; and Sheila Fullerton, Assistant Director, BHDS. Ms. Fullerton thanked the Commissioners, caregivers and the community for supporting her team's efforts to end the stigmas associated with those with neurodiversity issues. She expressed gratitude for those who promote neurodiversity and ensure that all residents have the freedom to live their lives to their fullest potential. Mr. Maggi read the proclamation declaring April 24-27 2023 as National Library Week in Washington County. Moved by Mr. Maggi; seconded by Mr. Sherman, to approve the proclamation. Accepting the proclamation was Chad Gump, Executive Director, Washington County Library System and various library representatives. Mr. Gump thanked the Commissioners for all their support of the county library system and recognized directors and staff members throughout the county for their dedication. He went on to highlight current programs that benefit all county residents and beyond. Programs like free literacy, free museum passes, hybrid programming, and large-scale summer activities, including the upcoming collaborative summer reading event to be held in Mingo Park on July 29, 2023. Mr. Maggi read a proclamation declaring April 2023 as Sexual Assault Awareness Month. Moved by Mr. Maggi; seconded by Mr. Sherman, approving the proclamation. Accepting the proclamation is Joanna Dragan, Supervisor, Sexual Violence Services (STTARS), SPHS Care Center, and organization representatives Brianna Bendic and Kristin Hobing. Ms. Dragan thanked Commissioners for their ongoing support. She also recognized all staffers, including those who could not be present. Ms. Dragan also gave a shout out to all the community organizations that collaborate with her organization, including Children & Youth Services, Behavioral Health and Developmental Services, Watchful Shephard USA, law enforcement, and the various medical systems who help reduce the stigma associated with sexual assault and provide community support for all survivors. Ms. Dragan mentioned that her organization serves 600-700 survivors each year in Washington and Greene counties. Accepting the proclamation is Tracy Walnoha, Executive Director, Watchful Shepherd USA and representatives Jennifer Pierosh and Joe Femiani Jr. She expressed her sincere appreciation for all the support Commissioners have provided over the years and recognized her peers, and other organizational representatives like Ms. Dragan and her team, as well as those from Washington County Children and Youth Services. For 29 years, Watchful Shepherd USA has provided home -alert units that kept children safe inside their homes, and for the past year, they have also been able to help outside the home with the launch of a mobile security device. When this device is paired with a cell phone, it can travel wherever children go. This is all offered free of charge, thanks to the fundraising they do. Ms. Walnoha expressed specific gratitude to Mrs. Vaughan for her support with the Dancing for a Cause fundraiser over the years. Mr. Maggi read a proclamation declaring April 12, 2023 as 412Thrive Day. Moved by Mr. Maggi; seconded by Mr. Sherman, approving the proclamation. She began by thanking the Commissioners for their continued support and told her story of how she founded 412Thrive after her ordeal and that of others, who in their 20s, were misdiagnosed and even ignored when they showed obvious signs of breast cancer. Unfortunately, some of these young women died. In an eff ort to educate young people about the possibility of developing breast cancer at an early age, her organization provides support and care packages, free of charge, and are working to provide services to high schools, colleges and universities. Mrs. Vaughan read and presented certificates of recognition honoring female US Army veterans Dr. Sally Mounts, Chief Development Officer, City Mission and Dr. Susan Morris -Rutledge, Associate Professor of Middle/Secondary Education, Pennsylvania Western University in California, PA. RECESS FOR PHOTOS PUBLIC COMMENT Mrs. Vaughan stated that the views and opinions expressed by the speakers during public comment are exclusively those of the speakers and do not reflect or represent those of the Washington County Board of Commissioners and have not been verified. The following Washington County residents addressed the Commissioners during public comment: John Timney, Executive Director of the Washington County Authority, gave an update on the county's broadband project and thanked the Commissioners for their support. He also thanked the board for approving last month's request to consider the unserved areas of Jefferson Township, Canton Township, and Taylorstown targeting about 400 locations. This month the authority is requesting consideration for approximately 700 unserved locations in Hanover Township and Burgettstown. He noted that broadband expansion is very expensive (at about $65,000 per mile) so they would like permission to apply for a $2.5 million grant for East Finley Township with the Appalachian Region Commission. David Richards, representing the men and women of law enforcement as the president of the Fraternal Order of Police Lodge 22, said over the last several months he has received many complaints about 2140 MINUTE BOOK BOARD OF COMMISSIONERS WASHINGTON COUNTY, PENNSYLANIA IMR LIMITED E1316649LD the status of the police radios. He said the radio system has been bad for 20 years. He said the Commissioners need to find common ground and do what needs to be done to correct the problem. Chuck Hnot, a resident of Canonsburg, was compelled to attend the meeting after reading a newspaper article about the emergency radio system project. He has 40 years of hands-on experience and has been involved with hundreds of projects like this and is interested in seeing that first responders get a system that meets their requirements. He said it appears as if the current direction of the project is in opposition to the recommendations of the consultant and review committee. He suggested the board use the American Rescue Plan Act money to build the project in phases; use the money to purchase radios for the first responders; or cancel the project and reissue the Request for Proposals. Jodi Noble, of the Washington County Association of Township Officials, thanked the Commissioners for addressing the emergency communication deficiencies. She said emergency communications are critical and asked the Commissioners if the frequency study is complete, and she asked if the Commissioners would be willing to meet with their executive committee to discuss the project. THE BOARD OF COMMISSIONER'S RESPONSE & STATEMENT Chairperson Irey Vaughan said as far as the radio system is concerned the only reason the county can pursue this project is because of American Rescue Plan Act funding. She noted that there is a timeline under which the spending must be completed, and Motorola's proposal did not provide for the competition of the project within that timeline. She also said that the Taite proposal (MRA) saves $7,695,000 (over the Motorola proposal). In addition, the proposal, on an annual basis, would cost $600,000 to $800,000 more per year for public safety, if it had been the Motorola proposal. Motorola stated they would not provide a VHF proposal, even though the committee said they preferred a VHF proposal. She said the study is not complete and that the Commissioners would be willing to schedule a meeting with the Washington County Association of Township Officials. On another matter, Chairperson Irey Vaughan said a lawsuit has been filed against the county, the prison board, the Washington County correctional facility, and the warden, and a story about the lawsuit appeared in today's Observer -Reporter and on its website. She was briefly interviewed by reporter Mike Jones about this lawsuit and the article was accurate regarding her statement which said "All policies and procedures were followed. There is no wrongdoing on behalf of Washington County. This is nothing more than theatrics and meritless nonsense." However, Chairperson Irey Vaughan said it has come to her attention that Brenda Davis, an elected official, posted on her Facebook page a complete misstatement of what was said. Ms. Davis informed her Facebook followers that she (Chairperson Irey Vaughan) had said the opposite - that no policies and procedures were followed and that there is wrongdoing on the part of the county. Ms. Davis's inference is that she (Chairperson Irey Vaughan) believes the lawsuit has merit. However, nothing could be further from the truth. Ms. Davis has since removed the erroneous quote completely from her Facebook page. Chairperson Irey Vaughan said it is unconscionable for Ms. Davis to be discussing litigation involving the county and the warden on her Facebook page. The lawsuit has nothing to do with her (Ms. Davis) at all and she knows nothing about the facts of the matter. Ms. Davis's inaccurate quote is a clear deliberate attempt to place the county, the warden, and herself (Chairperson Irey Vaughan) in a false light with the citizens of Washington County and she (Ms. Davis) is clearly doing so for her own political gains. In addition, it should be noted that Ms. Davis is an elected official who is running to retain her position as the Clerk of Courts. Chairperson Irey Vaughan said lawsuits are not won or lost in the newspaper or on social media but tried in a courtroom. Chairperson Irey Vaughan said she will be consulting with her own legal counsel to possibly pursue litigation to put a stop to this outrageous behavior. OLD BUSINESS BID AWARD Solicitor Grimm recommended the Board, on behalf of Purchasing, award the Broadband Services proposal for a unified turnkey solution providing Broadband Connectivity for 680 residential and commercial targets in the North Hanover Township, South Hanover Township and Burgettstown, PA areas to Comcast Cable Communications, LLC, of Philadelphia, PA for 116 miles of fiber at a total cost of $8,164,724 of 2141 MINUTE BOOK BOARD OF COMMISSIONERS WASHINGTON COUNTY, PENNSYLANIA IMR LIMITED E1316649LD which, Washington County will pay $3,836,719 the remainder will be supplemented by Comcast. Cost will be funded from the American Rescue Plan Act Fund. Moved by Mr. Sherman, seconded by Mr. Maggi, approving the broadband services proposal for a unified connectivity solution for Hanover Townships, Burgettstown, PA areas to Comcast Cable Communications, LLC. Solicitor Grimm recommended the Board, on behalf of the Planning Commission, award the bid for the Cross Creek Shelter site preparation project to A. Liberoni, Inc., Plum, PA, at a total cost of $2,072,924.58. This award is being made to the lowest most responsible and responsive bidder meeting requirements. Bid responses were reviewed and recommended for award by the Purchasing and Planning Departments. Costs will be paid from Mingo Gas Lease funds. Moved by Mr. Sherman, seconded by Mr. Maggi, approving the bid award for the Cross Creek Shelter site preparation project to A. Liberoni, Inc., Plum, PA for a total cost of $2,072,924.58. Solicitor Grimm recommended the Board, on behalf of Purchasing, award the bid for the "Joint Municipal Purchasing Program" for Washington County to the listed vendors based on their delivered per unit cost, as submitted in their bid proposals: 1. One Nation Distribution, New Wilmington, PA 2. Coolspring Stone Supply, Uniontown, PA 3. Midland Asphalt., Bloomsburg, PA 4. Russell Standard, Valencia, PA 5. Heidelberg Materials Northeast, Connellsville, PA All items have been awarded to the lowest most responsive and responsible bidders meeting specifications. If approved, this contract will be effective upon the date of approval through April 4, 2024, at a total yearly cost of approximately $12,000. All bid responses were reviewed and recommended for award by the Planning and Purchasing Departments. Moved by Mr. Maggi, seconded by Mrs. Vaughan, approving the bid award proposal for the "Joint Municipal Purchasing Program" for Washington County to the listed vendors for a total yearly cost of approximately $12,000. CHANGE ORDER 2142 MINUTE BOOK BOARD OF COMMISSIONERS WASHINGTON COUNTY, PENNSYLANIA [MR LIMITED El316649LD Solicitor Grimm recommended the Board, on behalf of Purchasing and Building and Grounds, approve Change Orders #4 & #5 with StoneMile Group, Inc., Canonsburg, PA. for the Courthouse Courtroom 7 renovation as follows: Change Order #4 is for the duct work and piping penetrations in the Courthouse basement in the amount of $13,358 and includes the following: • Additional double steel channels required to be installed for the HVAC penetrations in vault. • Provide and install (2) channels, (4) 3/8" plates, conduit cutouts, (15) through bolts w/epoxy adhesive, and field welding of 3/8" plates to channels after installation. Off hours work is included. Change Order #5 is for voids in the floor ceiling system of Courtroom #7 in the amount of $23,897 and includes the following: Additional bracing and anchors to the main beam in the Courtroom, steel plate gussets, concrete in -fill @ void, plus additional labor and material to the steel contractor's package. Change orders 4 & 5 will increase the amount of the current contract from $2,622,331.65. to $2,659,586.65. Both Change Orders were reviewed and recommended by Justin Welsh, Building & Grounds, Pat Grimm, Courts Macbracey, and Buchart Horn, Inc. Chief Clerk presented to the Board for their consideration and approval, on behalf of the Correctional Facility, an agreement with TextBehind for the digitization of inmate family and friends' mail. The agreement will be in the amount of $500/month, will be funded by Inmate Welfare funds, and the service will be effective 30 days after agreement execution. Chief Clerk presented to the Board for their consideration and approval, on behalf of the Planning Commission, an agreement with PADOT under the Locally Owned Historic Truss Project which transfers responsibility to PADOT for design, design development activities, right-of-way acquisition, utility relocation coordination, contract development, letting and award, construction, construction inspection and all other activities incidental to the design and construction of the Project. Costs will be paid 100% with State funds. The agreement also authorizes the Chair of the Board of Commissioners to execute all documents for the project. Moved by Mr. Sherman; seconded by Mr. Maggi, approving a liquid fuels agreement with PADOT to transfer responsibility of the Locally Owned Historic Truss Project. Chief Clerk presented to the Board for their consideration and approval, on behalf of the Planning Commission, of a Memorandum of Understanding (MOU) with the Pennsylvania Resources Council (PRC) for a Household Hazardous Waste and Tire Collection event to be held June 24, 2023. Washington County will pay PRC $6,500 to assist with the cost of the event. Funds will come from the recycling account. Moved by Mr. Sherman; seconded by Mr. Maggi, approving a Memorandum of Understanding (MOU) with the Pennsylvania Resources Council (PRC). Chief Clerk presented to the Board for their consideration and approval, on behalf of Planning and Parks and Recreation, a Request For Proposal (RFP) from qualified engineering and planning firms to complete a Master Site Plan for all county parks. The current plans completed in 2014 have been substantially implemented. The new plan will complete an analysis of the parks to determine features and amenities for future development or redevelopment. Moved by Mr. Sherman; seconded by Mr. Maggi, approving the request for proposal for a Master Site Plan for all county parks. Chief Clerk presented to the Board for their consideration and approval, on behalf of the Correctional Facility, a renewal agreement with the County of Allegheny for the housing of inmates. The agreement is reciprocal between both parties with a daily housing fee of $158.04 charged by Allegheny County Jail and a daily housing fee of $87.32 charged by the Washington County Correctional Facility with each facility responsible for the cost of medical care for their placed inmates. The agreement will be effective May 1, 2023 through April 30, 2024, and is contingent upon approval at the Prison Board meeting on April 19, 2023, Minute No. PB 4-19-23. Chief Clerk presented to the Board for their consideration and approval, on behalf of Finance and the Sheriff, a subgrant agreement with the Borough of Canonsburg for police training grant monies from the Commonwealth of Pennsylvania. The agreement is in the amount of $260,515 and will reimburse the County for all costs associated with the training.
